Delta Flight Delay and Cancellation Compensation
What Delta commits to, what US, EU, UK and Canadian rules may add, and how to claim, based on Delta's and the regulators' own pages.
If Delta delays or cancels your flight, what you can get depends on why, how long, and where you were flying. In the US the main right is a refund; cash compensation for a delay isn't required by US law, though Delta commits to meals, hotels and rebooking when the disruption is its fault.
Short answer
A Delta delay does not automatically entitle you to cash compensation. Under US rules you are owed a refund if Delta cancels or significantly changes your flight and you don't travel; Delta also commits to meals, hotels and rebooking when the disruption is within its control. Departures from the EU, UK or Canada can bring EU261, UK261 or APPR compensation.

Delta delay and cancellation scenarios
| Scenario | What Delta's own pages say | What regulators may add |
|---|---|---|
| Delay within Delta's control, 3+ hours | Meal or meal voucher after a wait of 3+ hours; hotel and ground transport if the delay runs overnight; free rebooking. US and Canada residents can submit a Reimbursement Request for meals, hotel and transport for Delta-controlled delays of 3+ hours. | No US cash compensation for delays. A refund if you decline a significantly changed itinerary (3+ hours domestic / 6+ international). |
| Delay from weather or air traffic control | Delta's page says weather and ATC delays are not reimbursed. | Refund rights if you decide not to travel after a significant change. EU261/UK261 and APPR have their own extraordinary-circumstances rules. |
| Cancellation | Delta auto-rebooks where possible. If you decline the new itinerary you can cancel for a refund of the unflown portion (plus seat and bag fees) or take a 5-year eCredit. Free rebooking on the next Delta flight, or a partner airline if none is available. | US DOT: automatic refund if you aren't rebooked or decline the alternative: 7 business days (card) / 20 calendar days (other). |
| Denied boarding (oversold) | Contract of Carriage Rule 20: 200% of the fare up to $1,075 when Delta arranges alternative transport; 400% up to $2,150 when it can't. Up to a $100 credit voucher if an overnight stay is needed and no hotel is available. | Matches the DOT maximums. |

Does your Delta flight qualify?
- Find your flight details. Note the airline, flight number, date, booking reference, and your scheduled and actual arrival times (from your boarding pass, email confirmation or the airline app).
- Measure the delay at arrival. EU261, UK261 and Canada's rules count the delay at your final destination, not departure. Under US DOT rules, a refund is triggered by a change or delay of 3+ hours (domestic) or 6+ hours (international).
- Work out which rules cover the flight. Look at where it departed and landed and who operated it: a departure from an EU or UK airport brings EU261 or UK261, flights touching Canada fall under APPR, and flights to, from or within the US fall under the US DOT rules.
- Find the cause. Compensation regimes generally exclude extraordinary circumstances such as severe weather, air traffic control restrictions or security risks. Ordinary technical faults are treated differently in different places, so ask the airline to state the cause in writing.
- Check the notice you were given. For cancellations, the amount of notice (for example under 14 days) can decide whether compensation applies.
How to claim from Delta
- Refund for a cancelled or significantly changed flight: use Delta's cancel and refund page or the refund form. Delta refunds to the original payment method: cards typically within 7 business days (it can take up to two billing cycles to post), other methods about 20 days.
- Meals, hotel and transport: US and Canada residents can use the reimbursement request on Delta's delayed or canceled flight page for Delta-controlled disruptions; others use the comment and complaint form. Keep receipts.
- Compensation on an EU departure: use Delta's EU compensation request page ('Create my request'). Delta's page doesn't describe a separate UK261 process or state a filing deadline.
- Denied boarding: see Rule 20 in Delta's Contract of Carriage.
- Canada flights: see Delta's Canada passenger rights page and claim in writing within one year.
Delta says complaints and comments through its Help Center are acknowledged within 30 days and answered within 60. If Delta doesn't resolve a US-related complaint, you can file with the DOT's aviation consumer complaint form.
EU261 reform: what has changed and what hasn't
Today's rules are still Regulation 261/2004
The EU adopted a regulation amending EU261 in 2026 (Regulation (EU) 2026/2202). According to the Council, it keeps the 3-hour threshold and broadly similar compensation amounts, adds a defined list of extraordinary circumstances and stricter duties on airlines. EUR-Lex shows it entering into force on 22 October 2026, but law-firm commentary says most provisions apply only from October 2027. Until the new rules apply, the current rules above are what govern a claim. The reform does not apply in the UK, where UK261 remains in force. Check the Council announcement and EUR-Lex for the current position.

Travelling? Keep your claim and booking details private
Claim forms and booking pages ask for names, booking references and contact details. Airport and hotel Wi-Fi are shared networks, so avoid filing claims or opening booking emails on them unprotected. A VPN encrypts your traffic between your device and the VPN server, which helps protect it on shared networks; it does not change what compensation you are owed. See how a VPN works.
